Terms of Service

These Terms of Service ("Terms") govern your access to and use of HydroMind.AI (the "Service"), operated as an individually-owned software product ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

HydroMind.AI provides an AI-powered hydraulic and crane diagnostics platform, including an AI advisor, hydraulic system design tools, fault diagnostic reference material, and a technical knowledge base. The Service is offered on Free, Pro, and Enterprise subscription tiers, each with different feature access as described on our Pricing page.

Not professional engineering advice. Content, diagnoses, and recommendations produced by the Service are AI-generated guidance intended to support your own professional judgment. They are not a substitute for certified inspection, manufacturer documentation, or a qualified engineer's sign-off, particularly on safety-critical systems, suspended loads, or pressurized components. You remain solely responsible for verifying any output before acting on it.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials secure.
You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to circumvent usage limits.

3. Subscriptions, Billing & Trials

The Free tier is available indefinitely subject to its stated usage limits.
The Pro tier includes a 7-day free trial. No payment method is required to start the trial. If you do not upgrade to a paid plan before the trial ends, your account reverts to the Free tier automatically — you will not be charged.
Paid subscriptions (Pro, Enterprise) renew automatically at the interval you select (monthly or annual) until cancelled.
You can cancel a paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain paid-tier access until then.
Prices are shown in USD and may change with reasonable advance notice; changes will not apply retroactively to a period you've already paid for.

4. Payments & Paddle

Payments for HydroMind.AI subscriptions are processed by our reseller, Paddle.com Market Limited ("Paddle"). Paddle acts as the Merchant of Record for all purchases and is the seller of record on your invoice and bank/card statement. Your purchase is subject to Paddle's own Buyer Terms in addition to these Terms. Paddle handles payment processing, invoicing, and applicable sales tax/VAT collection on our behalf.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of applicable export control or sanctions laws;
Attempt to reverse-engineer, scrape, or resell access to the Service or its knowledge base;
Share a single account across multiple individuals in a way that circumvents per-seat or usage-based pricing;
Use the Service to generate content that infringes third-party intellectual property.

6. Intellectual Property

HydroMind.AI, its software, knowledge base content, and branding are owned by us and our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your own professional or personal purposes. You retain ownership of any content you upload (e.g. photos, job notes) to the Service.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be complete or correct for your specific equipment or circumstances.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of equipment, production, or life/safety incidents arising from reliance on Service outputs without independent verification. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service for breach of these Terms, non-payment, or extended inactivity. You may stop using the Service and close your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your home jurisdiction apply and cannot be waived.
